1. Scope​

These Terms and Conditions apply to all orders placed by consumers through the online shop Florhea via Wix webshop and Florhea’s Etsy shop.

A consumer is any natural person entering into a legal transaction for purposes predominantly outside their trade, business, or profession.

2. Products​

Florhea offers handmade and artistic products, including but not limited to:

• Art prints

• Macramé wall art

• Macramé home ritual kits

• Handmade ceramic pieces

Some products are ready-made and available from stock. Others may be made-to-order or individually handcrafted, which may involve slight variations in color, texture, form, or detail. Such variations are characteristic of handmade work and do not constitute defects.

3. Conclusion of Contract​

Product listings in the online shop do not constitute a legally binding offer but an invitation to place an order.

By submitting an order, you make a binding offer to purchase the selected goods.

The contract is concluded only when order acceptance is confirmed by email or the goods are dispatched.

4. Prices and Payment​

All prices are stated in Euro (EUR) and include applicable statutory taxes unless otherwise indicated.

Shipping costs are shown separately during checkout.

Accepted payment methods include those offered through Wix Payments and Etsy, including:

• Credit/Debit Card

• PayPal

• Additional payment options made available at checkout

Payment is due immediately upon order.

5. Shipping and Delivery​

Delivery is currently available within the European Union.

Estimated shipping times are provided in the product listing or during checkout. Delivery times for made-to-order products may be longer.

The seller is not responsible for delays caused by customs, postal services, force majeure, or circumstances beyond reasonable control.

Please inspect parcels upon arrival. Damage during shipping must be reported within 48 hours with photos of packaging and item.

6. Right of Withdrawal (Consumers)​

Consumers have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you or a third party designated by you receives the goods.

To exercise your right of withdrawal, you must inform us by clear statement (for example by email).

Returned goods must be sent back within 14 days after withdrawal notice.

Return shipping costs are borne by the buyer.

Refunds will be issued after receipt and inspection of returned goods, using the original payment method.

7. Exceptions to the Right of  Withdrawal​

The right of withdrawal does not apply to:

• Goods made to the consumer’s specifications

• Clearly personalized or custom-made products

• Sealed goods not suitable for return for hygiene reasons, if unsealed after delivery (if applicable)

This does not affect statutory consumer rights under applicable law.

8. Returns Condition​

Returned items must be unused, undamaged, and returned in their original packaging where possible.

The buyer is responsible for any diminished value resulting from handling beyond what is necessary to inspect the goods.

9. Warranty (Gewährleistung)​

Statutory warranty rights under Austrian and EU law apply.

If a product arrives damaged, defective, or incorrect, please contact us promptly at [insert email].

Handmade variations described in Section 2 are not considered defects.

10. Liability​

Florhea is liable without limitation in cases of intent or gross negligence.

For slight negligence, liability is limited to breaches of essential contractual obligations and foreseeable damages typical for the contract.

Mandatory statutory liability remains unaffected.

11. Intellectual Property​

All artwork, designs, texts, images, and product concepts remain the intellectual property of Florhea / Flora Zsofia Kekes unless otherwise stated.

Reproduction, resale, or commercial use without written permission is prohibited.

12. Applicable Law​

These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions in the customer’s country of residence remain unaffected.

13. Online Dispute Resolution​

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.
